These terms govern your use of marbellatechsolutions.com and the services provided by Marbella Tech Solutions (sole trader / autónomo), registered in Spain, operating from Marbella, Málaga.
Marbella Tech Solutions provides IT support, web development, AI and automation, digital marketing, custom software and mobile app development services. The scope, price and timeline for each project or retainer is agreed in writing before work begins.
All work is quoted in writing before starting. Fixed-price projects require a deposit (typically 50%) before work commences, with the balance due on delivery. Monthly retainers are billed at the start of each month. Prices are quoted in EUR and are exclusive of Spanish IVA (21%) unless otherwise stated.
On full payment, you own all deliverables created specifically for your project (websites, code, designs). We retain the right to reference the project in our portfolio unless you request otherwise in writing. Third-party components (themes, plugins, libraries) are subject to their own licences.
We treat all business information you share with us as confidential. We will not disclose it to third parties except where required by law or where necessary to deliver your service (e.g. hosting providers).
Marbella Tech Solutions' total liability for any claim shall not exceed the total fees paid in the 3 months preceding the claim. We are not liable for indirect or consequential losses, loss of profit or loss of data. We are not responsible for third-party services (hosting, payment gateways, advertising platforms) over which we have no control.
Either party may terminate a retainer with 30 days' written notice. Fixed-price projects may be cancelled by you before delivery — you forfeit the deposit. We may suspend services immediately if invoices are 30 or more days overdue.
These terms are governed by Spanish law. Any disputes shall be subject to the jurisdiction of the courts of Marbella, Málaga, Spain.
We may update these terms at any time. Continued engagement with our services after notice of changes constitutes acceptance.
